1. Operator

This website and the services described herein are operated by Scantr LLC, doing business as Elevarq ("Elevarq," "we," "us," or "our").

2. Scope

These terms govern your use of the Elevarq website (elevarq.com), the customer portal, and the Arq analysis and reporting services. By accessing or using any part of the service, you agree to be bound by these terms.

3. Acceptable use

You agree to use the service only for lawful purposes and in accordance with these terms. You may not use the service to attempt unauthorized access to systems, interfere with service operation, or reverse-engineer proprietary components.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized access or use.

5. Payments and subscriptions

Some features of the service require payment. Fees are described at the time of purchase and may be charged via payment card or invoice. All fees are non-refundable unless otherwise stated.

If payment is not received when due, we may suspend or restrict access to paid features until the outstanding balance is resolved.

6. Customer data responsibility

You are responsible for ensuring that you have the necessary rights and permissions to submit or process data through the service. Elevarq is not responsible for the legality, accuracy, or appropriateness of data you provide.

7. Compliance with laws

You agree to comply with all applicable laws and regulations when using the service, including data protection, export control, and anti-corruption laws.

8. Intellectual property

The service, including its design, code, documentation, and branding, is the intellectual property of Scantr LLC. You may not copy, modify, distribute, or create derivative works based on the service without prior written permission.

Analysis results and reports generated for your data remain associated with your account. Your data remains your property.

9. Service availability and changes

The service may be modified, updated, or discontinued at any time. We will make reasonable efforts to provide notice of significant changes, but we do not guarantee uninterrupted availability.

10. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

11. Limitation of liability

To the maximum extent permitted by applicable law, Scantr LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, whether in an action in contract, tort, or otherwise, arising out of or in connection with the use of the service.

Our total liability for any claim arising from or related to the service shall not exceed the fees you paid to Elevarq in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Scantr LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any applicable law.

13. Termination

You may stop using the service at any time. Elevarq may suspend or terminate your access if you violate these terms, fail to pay applicable fees, or if continued access poses a security risk.

Sections that by their nature should survive termination (including limitation of liability, indemnification, and intellectual property) will remain in effect.

14. Governing law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

15. Changes to these terms

We may update these terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the service after changes constitutes acceptance of the revised terms.
